In order to hardcode subtitles to MKV or MP4 video, just select MKV or MP4 as the output format. The backup can be copied automaticly if you edit the kodi start script. Run Handbrake to import the video file you want to hardcode subtitles. Kodi will now work as you expect and if you open kodi's settings it will overwrite the copy which can be easily restored.
